Need some advice about court appearances while incarcerated

My son is finishing up his incarceration in a few months, but he has an unresolved issue in a nearby county (45 minutes away).

He has a public defender in that county. The offense was 3 years before he was incarcerated. (2019)

Since that time, they have sent out threatening letters and warrants for his arrest. No matter how many times they are told that he cannot get to court due to being incarcerated.

Now, he keeps getting a court date WEEKLY to show up in this other countyAND an order to transport has been issued over 10 times. Yet they never arrange to get him.

Recently he had a parole hearing and they refused to grant parole with the other offense pending.

Is there anything we can do?

It could mean getting home 3-4 months earlier.

So frustrating. 😞

Thanks for your response.

No, no updates except that the judge and the Public Defender both rolled their eyes when he was not brought to court a month ago. Evidently the Public Defender had been making the requests for the transfers, so at that time the judge said he would make the request personally, so that perhaps it would be respected.

The result was that again he was not transferred the 30 miles to the court where he needed to be at the end of October. I will be driving back there in a couple of days to see if they will be bringing him to court this time.

I can’t decide whether this is all just total bullshit, or if it’s a God thing. Either my son is facing remaining in jail for a longer period of time because this has not been taken care of by the courts, or perhaps there’s one more lesson he needs to learn before he comes home and that will take more time.

I just want him home so badly. I’ve seen him three times in the past three years. Twice across a courtroom, and once in a small room for a parole hearing, but no talking to him, and no touching him. To have suffered the loss of his dad and not have so much as a two or three hour furlough to attend his service past has had to have had a huge impact on him. I just want him home.

WR- I hope the courts do right by your son. What a long ordeal for you both.

How are you otherwise?

Thank y’all.

FINALLY, he was transported and in court Thursday morning. Nothing was resolved but I did get to see him. His Public Defender spoke with me before the court appearance. She said that his case was being moved to a different court, and that she had spoken to the district attorney in that particular court, who said that she was not going to put more time on him… That it would be time served. But that she might put, more supervision on him… Which is fair.

Perhaps the most exciting thing was that we were told that the process of transporting him so that he could actually get to court was much more efficient, and there would not be all of these postponements. She said she could not GUARANTEE, no additional time, but she feels almost 100% sure about it.

The most exciting most amazing part of the day was that I got to see him. His hair was not braided look like it was up till yesterday, and looked like a hot air balloon. And when he walked into the courtroom, he was beaming. I was so happy that he accepted her news as very good news, and when he looked over and saw my sister and I, he was truly beaming. One of those smiles that, actually glows. And then when he turned around to leave, of course we’re not allowed to speak to him or get near him, but he shot me that smile again, and flashed me an " love you" sign. Just to know that he felt that level of happiness, even if just for just a couple of minutes was enough to keep me going.

It looks like it might be an end of February that he will come home. Of course he won’t be coming home to my house, but will be going back to his family, through the grace of God they have been able to hold together.

I just keep watching every step that I make so that I don’t trip over something and get hurt. Or get sick. Or something happen to me before he gets home. It’s gonna be hard enough for him to walk into this house with his dad not here. I’ve got to have everything else as positive as I can possibly make it.
